DHS Secretary Napolitano's Immigration, Border Security Plan

On Friday, January 30, Secretary of Homeland Security Janet Napolitano sent a copy of her immigration and border security directive to the 14,000-member National Association of Chiefs of Police. While her plan does not appear much different from the one formulated and promulgated by the previous DHS Secretary, Michael Chertoff, the language used appears more politically correct and intended to elicit support from opponents.

The directive requires specific department offices and components to work together and with state and local partners to review and assess the plans and policies to address: criminal and fugitive aliens; legal immigration benefit backlogs; southbound gun smuggling; cooperation with the National Guard; widows and widowers of U.S. citizens; immigration detention centers; and electronic employee verification.

N.Y. Guard Provides Helicopter Training to Canadian Aircrews

N.Y. Guard Provides Helicopter Training to Canadian Aircrews

New York Army National Guard members offered hands-on CH-47 Chinook helicopter training to Canadian air force aircrews readying for deployment at a flight facility here last week.

Aviation soldiers from the Guard's Company B, 3rd Battalion, 126th Aviation Regiment, who returned from a tour of duty in Afghanistan in April, used their Chinooks and the upstate New York snow to train the Canadians on Afghan flying conditions.

The snow was a stand-in for the ubiquitous Afghan dust, Army Capt. Eric Fritz, instructor pilot for the battalion, explained. Fritz put together a two-week training program to prepare the Canadians for an upcoming Afghan deployment.

Members of the Canadian air force's 408th and 430th Tactical Helicopter Squadrons will be operating Chinooks in theater. The Canadian aircraft already are 6,000 miles away in place in Afghanistan.

"Everybody jumped at the opportunity to provide the training and transmit Company B's experience and information to the Canadians," Army Col. Michael Bobeck, aviation officer, said. "It makes everybody operate safer and allows us to accomplish the mission."

The first week of training focused on classroom briefings, battlefield scenarios and daylight-flying operations, and the second week was spent perfecting night-flying skills. The training plan culminated with a simulated air assault. All training flights took place within 100 miles of the flight facility here.

Landing and taking off in the light snowfall provided the Canadians with the same experience they'll get coping with the ever-present dust in Afghanistan, Fritz said.

"The New York National Guard has been very accommodating, because it's all been last-minute for us," Canadian air force Capt. Martin LeFrancois, 430th Squadron, said. "Now that we have six Chinooks waiting for us in Afghanistan, the training program that they prepared for us will be really beneficial."

Feds Capture International Fugitive Wanted for Two Murders in Colombia

(This report is based on documents obtained by the National Association of Chiefs of Police.)

Immigration and Customs Enforcement  agents arrested a 41-year-old Colombian national wanted by the Colombian government for a 1994 double homicide. His initial court appearance was yesterday in the Southern District of Florida on federal charges of making false statements to a federal agent and he is pending extradition to Colombia.

"Apprehending dangerous foreign fugitives hiding in the United States is a top priority of ICE and our international and local law enforcement partners, including the Miami Dade Police Department and Interpol," said Anthony V. Mangione, special agent in charge for the ICE Office of Investigations in Miami.

"It is in the interest of public safety and justice around the world to capture and return wanted fugitives to their native countries to face justice," he said.

The fugitive was identified as Raul Sanabria Castaneda, aka Ramon Diaz, formerly residing in Pembroke Pines, FL. ICE special agents arrested Castaneda without incident on Friday, January 23, 2009, on immigration violation charges at the Miami Dade courthouse after he appeared in court for his arraignment on state misdemeanor charges for two counts of battery and one count of disorderly intoxication under the alias of Ramon Diaz.

On December 26, 2008, Sanabria-Castaneda was arrested by officers of the Miami Dade Police Department (MDPD) on the local charges. The MDPD's Homeland Security Bureau contacted ICE because the defendant's immigration status was questionable and information they had obtained from Interpol. ICE special agents conducted an investigation and discovered that the defendant was in the United States illegally. A fingerprint analysis of the defendant returned positive results for an Interpol Red Notice for an international fugitive, Raul Sanabria Castaneda.

ICE special agents interviewed Castaneda, who claimed he was Ramon Diaz, a citizen of Venezuela, having legally entered the United States approximately 10 years ago through John F. Kennedy International Airport. Further investigation revealed that Sanabria Castaneda entered the United States without inspection. He was charged federally with making false statements to a federal officer and appeared yesterday before U.S. Magistrate Judge Patrick A. White, who ordered him held without bond and set his arraignment date on February 9, 2009.

ICE Office of Investigations worked in close coordination with Interpol, the ICE Attaché in Colombia, and the Miami Dade Police Department to identify, locate, and apprehend this individual.

President of NY Investment Firms Charged in $370 Million Ponzi Scheme

Nicholas Cosmo, 37, the owner and president of Agape World, Inc. and Agape Merchant Advance, LLC, was arrested Tuesday night as a result of a federal complaint charging him with mail fraud, according to a report obtained by the Fraud & Corruption Committee of the National Association of Chiefs of Police.

Federal agents executed search warrants at the Agape and AMA offices located in Hauppauge, Maspeth, and Jackson Heights (Queens County), New York, and the government has moved to freeze bank accounts related to Agape, AMA, Cosmo, and others, and has seized $1.5 million thus far. The defendant’s initial appearance occurred yesterday before United States Magistrate Judge E. Thomas Boyle at the U.S. Courthouse, 100 Federal Plaza, Central Islip, New York.

The charges were announced by Benton J. Campbell, United States Attorney for the Eastern District of New York, Ronald J. Verrochio, Inspector-in-Charge, New York Division, U.S. Postal Inspection Service, and Joseph M. Demarest, Jr., Assistant Director-in-Charge, Federal Bureau of Investigation, New York Field Office.

According to the complaint, the defendant planned and carried out a fraudulent scheme in which he, and others acting at his direction, represented to investors that money they invested in Agape and AMA would be used to provide short-term loans to businesses, that the loans would be secured by borrowers’ assets with 99% security on their investments, and that investors would receive substantial interest returns ranging as high as 48% to 80% per year.

While a small number of interest-generating loans were made to commercial borrowers, bank and trading records reveal that most of the money invested in Agape and AMA was used to pay prior investors, to pay more than $55 million to brokers who recruited the investors, and to fund seven commodities futures trading accounts controlled by Cosmo and through which he lost more than $80 million between October 2003 and October 2008.

The records also indicate that, from January 1, 2006, until November 30, 2008, more than $370 million was deposited into Agape and AMA bank accounts, the vast majority of which was provided by more than 1,500 investors, and that less than $10 million of the $370 million was actually lent to commercial borrowers. As of January 22, 2009, there was approximately $746,000 remaining in the Agape and AMA bank accounts.

By paying investors partial returns -- represented to be profits from interest-generating loans -- Cosmo persuaded current investors to invest additional funds in Agape and AMA, and also encouraged new victims to invest in the two companies. To conceal the fact that the returns paid to investors were really funds provided by new investors, Cosmo falsely inflated profits from some of the commercial loans that were actually made.

For example, he distributed approximately $5.2 million to more than 100 investors, claiming that the money represented the principal and profits related to a single commercial loan. In fact, that particular loan generated less than $45,000 in interest for Agape, and the balance of the $5.2 million return was drawn from funds provided by new victim-investors.

“This defendant, who operated a classic Ponzi scheme to enrich himself and his colleagues at the expense of investors, is now in custody and the government’s investigation is continuing,” stated United States Attorney Campbell. “In these difficult economic times, it bears repeating that if an investment opportunity seems too good to be true – promising unusually high returns and virtually no risk – it is probably not on the level.” Mr. Campbell extended his grateful appreciation to the Postal Inspection Service and the FBI for their assistance.

FBI Assistant Director-in-Charge Demarest stated, “Investors generally understand that there’s a correlation between risk and reward, and high-yield investments offer higher rates of return to compensate investors for greater risk. But Nicholas Cosmo not only understated the risk, he completely misrepresented the underlying investments. When you lie about what you’re selling people, that’s fraud.”

Postal Inspector-in-Charge Verrochio stated, “Operators of Ponzi schemes tell investors they can’t lose, when in fact most never win. The defendant in this case lured his clients with promises of high returns on their investments, but in the end his pyramid of deception came crumbling down but not before losing millions of dollars, their dollars! As long as Americans are victimized by those who use the U.S. Mail to defraud, Postal Inspectors will be on their trail.

If convicted, Cosmo faces up to 20 years in prison on the mail fraud charge. He also faces a fine of up to the greater of $250,000, or twice the pecuniary gain or loss. The government’s case is being prosecuted by Assistant United States Attorneys Grace M. Cucchissi and Vincent Lipari.

AIG Executive Sentenced to Four Years in Prison

The former vice president of reinsurance of American International Group Inc. (AIG), was sentenced yesterday to four years in prison for his role in a fraudulent scheme to manipulate AIG's financial statements, according to a Department of Justice report obtained by the National Association of Chiefs of Police's Fraud & Corruption Committee.

Christian M. Milton, 61, of Wynnewood, Pa., who served as vice president of reinsurance at AIG from approximately 1982 to March 2005, was convicted by a federal jury on Feb. 25, 2008, on charges of conspiracy, securities fraud, false statements to the U.S. Securities and Exchange Commission (SEC) and mail fraud. In addition to the prison term, Milton was sentenced by U.S. District Judge Christopher F. Droney to two years of supervised release following his release from prison and a $200,000 fine. Milton was ordered to surrender himself to federal authorities in 60 days.

Evidence presented at trial proved that Milton and his co-defendants, Ronald E. Ferguson, Elizabeth A. Monrad, Robert D. Graham and Christopher P. Garand, all former General Reinsurance Corporation (Gen Re) executive officers, engaged in a scheme to falsely inflate AIG's reported loss reserves, a key indicator of financial health to insurance industry analysts and investors. According to trial evidence, the fraud was carried out through the use of two sham reinsurance transactions between subsidiaries of AIG and Gen Re in response to analysts' criticism of a $59 million decrease in AIG's loss reserves for the third quarter of 2000.

The two sham transactions, evidence showed, increased AIG's loss reserves by $250 million in the fourth quarter of 2000 and $250 million in the first quarter of 2001, masking a declining trend in loss reserves in the face of premium growth. Evidence showed that AIG restated the transactions at issue in filings with the SEC in May 2005. Evidence presented at trial established that when the investigation was disclosed to investors by AIG and through various media outlets between Feb. 14 and March 14, 2005, shares of AIG stock dropped from $73.12 to $61.92.

All five defendants were convicted on all counts presented against them in the 16-count superseding indictment. Subsequently, on Oct. 31, 2008, Judge Droney found that AIG's shareholders lost between $544 million and $597 million as a consequence of the defendants' fraudulent scheme.

According to evidence at trial, each of the defendants knew that the true purpose of the transactions was to permit AIG to falsely report increasing loss reserves in its statements to analysts, investors and in its SEC filings. The defendants structured a sham reinsurance transaction, according to trial evidence, and created a phony paper trail to make it appear as though Gen Re had solicited reinsurance from AIG when the evidence demonstrated that the parties knew AIG wanted the transaction to manipulate its financial statements. Additionally, evidence presented at trial proved that the defendants entered into a secret side deal whereby AIG would never have to pay any losses under the contracts; AIG would return to Gen Re the $10 million in premiums Gen Re paid to AIG and AIG paid Gen Re a $5 million fee for entering into the transaction.

The case was prosecuted by Principal Deputy Chief Paul E. Pelletier and Assistant Chief Adam Safwat of the Criminal Division's Fraud Section as well as Assistant U.S. Attorneys Eric J. Glover of the District of Connecticut and Ray Patricco of the Eastern District of Virginia. Additional assistance was provided by Paralegal Specialists Sarah Marberg of the Fraud Section, and Amy Konarski of the District of Connecticut. The ongoing investigation is being conducted by the U.S. Postal Inspection Service.

CIA Director: Mexican Nationals' Violence a Threat to US

(This column is based on a report submitted to the National Association of Chiefs of Police by the US Department of Homeland Security.)

During Monday's edition of Fox News Channel's Glenn Beck Show, the decidely conservative host asked his viewers to answer a question: outgoing CIA Director Michael Hayden had stated that Iran was the Number One threat to the security of the United States; what country did Hayden rank as Number Two? The answer was Mexico.

Meanwhile, retired U.S. Army General Barry McCaffrey, the former U.S. drug czar, told the Los Angeles Times that the Mexican government "is fighting for its survival against narco-terrorism" and could lose effective control over large swaths near the U.S. border.

However, the new Secretary of Homeland Security, Janet Napolitano in a report obtained by the National Association of Chiefs of Police, stated on January 23 that, "The northern border of the United States has become, since 9/11, important to our national security. As we have designed programs to afford greater protection against unlawful entry, members of Congress and homeland security experts have called for increased attention to the Canadian border.

Foreign National Imprisoned for Smuggling East Africans into the US

A Ghanian man was sentenced Friday in the District of Columbia for his role in smuggling East Africans into the United States, according to reports and court papers obtained by the National Association of Chiefs of Police.

Mohammed Kamel Ibrahim, a/k/a Hakim, 27, a native of Ghana and naturalized citizen of Mexico, was sentenced to five years in prison by U.S. District Judge Ricardo M. Urbina after pleading guilty to one count of conspiracy and three counts of bringing aliens to the United States for profit.

According to his plea, Ibrahim operated an alien-smuggling organization in Mexico City that
moved unauthorized aliens from East Africa across the southern U.S. border beginning as early as
2005. In plea documents Ibrahim admitted that between June 2006 and February 2007 he and codefendant
Sampson Lovelace Boateng conspired to smuggle unauthorized aliens to the United States by providing the aliens with fraudulently obtained Mexican visas.

The visas, which Boateng obtained through a corrupt employee of the Mexican embassy in Belize, enabled East African aliens to travel into Mexico, then be smuggled across the southern U.S. border by
Ibrahim’s Mexico City-based organization.

According to the plea documents, Ibrahim’s organization smuggled the aliens by various means, including by concealing them for more than 12 hours in the sleeper compartments of commercial buses. In pleading guilty, Ibrahim admitted to smuggling between 25 and 99 aliens into the United States.

Ibrahim and Boateng were charged in a 28-count indictment returned by a federal grand jury in the District of Columbia on Oct. 31, 2007, and unsealed on Dec. 5, 2007. Ibrahim was arrested by Mexican authorities in Mexico City on Dec. 5, 2007, and extradited to the United States on April 24, 2008. Boateng was arrested at Miami International Airport on Nov. 5, 2007, after arriving on a commercial airline flight from Belize. Boateng pleaded guilty to conspiracy and alien-smuggling charges in the District of Columbia on April 22, 2008, and Ibrahim pleaded guilty on Sept. 22, 2008.

Boateng’s sentencing is scheduled for Feb. 22, 2009. Both men will be removed from the United States upon completion of their sentences.

The Department of Homeland Security's Federal Emergency Management Agency (FEMA) announced the release of the National Disaster Housing Strategy for natural (hurricanes, earthquakes, etc.)  or man-made (terrorist attack) disasters.

The Strategy summarizes, for the first time in a single document, the many sheltering and housing capabilities, principles, and policies that guide and inform the disaster housing process. The Strategy also charts the new direction that our disaster housing efforts must take to better meet the disaster housing needs of individuals and communities moving forward.

Obama Suspends Guantanamo Bay Commissions

And so it begins -- President Barack Hussein Obama's terrorism war strategy. Looks like he kept the right guy in place as the Secretary of Defense, although, in my humble opinion, Robert Gates was never gung-ho about fighting terrorists. Which may be why Obama kept him onboard.

Some conservative believe Gates is nothing more than a career political-hack more interested in his career and positive press coverage than in protecting Americans. Only time and future events will tell. He's no Donald Rumsfeld, who could give a darn about political correctness and news-media propagandists.

On Inauguration Day, responding to a presidential directive, Defense Secretary Robert Gates ordered a suspension of active military commission proceedings at the U.S. detention center at Guantanamo Bay, Cuba, according to American Forces Press Service's Gerry Gilmore.

President Obama, who had called for the Guantanamo facility's closure during his campaign, directed Gates to pause legal proceedings involving alleged terrorists being held and tried there, pending further guidance from the White House, spokesman Bryan Whitman told reporters, bloggers and Internet journalists.

The president directed the secretary, who then directed the Office of Military Commissions, to cease referring any new cases through the military-commissions process at Guantanamo and to request 120-day continuances on all ongoing active cases there, Whitman said.

Whitman said he anticipates that further White House guidance regarding Guantanamo Bay will follow.

"The president has clearly made his intentions well known" regarding activities at the detention center, Whitman said.

Gates has recommended shutting down the Guantanamo detention center since he was appointed defense secretary more than two years ago. In December, Gates requested a proposal for closing the facility.

Gates has stated that requirements for closing Guantanamo include constructing legislation that provides statutory framework for housing detainees outside the confines of Guantanamo Bay, Pentagon Press Secretary Geoff Morrell told reporters during a December 18 news conference.

The defense secretary "has asked his team for a proposal on how to shut it down [and] what would be required specifically to close it and move the detainees from that facility, while at the same time ensuring that we protect the American people from some very dangerous characters," Morrell said.

The Military Commissions Act of 2006 established procedures governing the use of military commissions to try alien unlawful enemy combatants engaged in hostilities against the United States for violations of the law of war and other offenses that can be tried by military commission, according to a military-commissions fact sheet.

The detention center at Naval Station Guantanamo Bay has housed nearly 800 suspected terrorists captured in Afghanistan, Iraq and other places since the start of the global war on terrorism that followed the September 11, 2001, terrorist attacks on the United States.

About 250 people are being held at Guantanamo today, including Khalid Sheikh Mohammad, the alleged mastermind of the 9/11 attacks.

The Transformation of Organized Crime

While most of the focus of federal law enforcement today is on counterterrorism, federal police agencies must still contend with more traditional anti-crime operations including emerging organized crime gangs.

Criminal enterprises represent a near and long-term threat to our nation. The criminal activities of these enterprises are increasing in scope and magnitude as they network with each other to expand operations worldwide. The geopolitical and technological changes of the last decade have allowed these enterprises to flourish globally, and their impact on the United States is expected to increase over the next five years.

Organized crime groups from Russia and other former members of the Soviet Union are engaged in racketeering activity, and are deeply involved in large scale white collar crime. They are skilled in the use of monetary systems to funnel and conceal the proceeds of their criminal activity, employing state-of-the-art encryption to safeguard their communication networks against traditional forms of detection.

Asian criminal enterprises are composed of U.S.-born citizens and immigrants. They are multi-crime organizations that, like other ethnically-based criminal enterprises, often victimize their own ethnic immigrant communities.

These communities are typically hesitant to report victimization to authorities. As the immigration of Russian, former Soviet Union, and Asian populations into the United States increases in the next five years, so too will related ethnic organized crime.

La Cosa Nostra and Italian organized crime enterprises still pose a significant threat and will continue to influence the political and economic structure of the United States through engagement in racketeering-related activity. Alien smuggling and human trafficking will also continue to pose significant threats to the national security, as transnational criminal enterprises expand their activities in this area for economic profit.

In addition, the ability to facilitate the entry of illegal aliens into the United States could potentially be used to increase the membership of some of these criminal enterprises such as La Mala Salvatrucha or MS-13.

An emerging crime problem is Balkan criminal enterprises, specifically Albanian transnational organizations or clans. They are rapidly expanding their criminal activities to include loan sharking, weapons trafficking, alien smuggling, stock market manipulation, human trafficking, and drug trafficking. Additionally, these clans are forming partnerships with La Cosa Nostra, or LCN, crime families, as well as challenging traditional organized crime enterprises for territory.

Major theft rings account for billions of dollars in losses suffered by our nation's businesses, with corresponding price increases passed on to the US consumer. Loss prevention and asset protection are top priorities for corporate America as increasingly sophisticated and highly organized criminal enterprises engage in cargo theft, high tech theft, vehicle theft, jewelry and gem theft, organized retail theft, art and cultural antiquity theft, and other major theft activity.

Drug trafficking remains a significant problem. The impact of illegal drug abuse is estimated to be over $160 billion in U.S. economic losses each year, including costs associated with health care, violent crime, and lost productivity. Colombian criminal enterprises are the largest source of cocaine in the world, and are also major heroin suppliers to the U.S. market.

Mexican criminal enterprises manufacture and supply much of the methamphetamine available in the United States, and transport the majority of cocaine and heroin into our nation. The ability of Mexican enterprises to corrupt public officials in Mexico and the United States has enhanced their capability to transport and distribute these illicit drugs.

Caribbean-based criminal enterprises specialize in the transportation and smuggling of drugs into Puerto Rico and the U.S. mainland. Over the next five years, South American and Mexican drug trafficking organizations will continue to maintain their dominance, and Caribbean-based groups will provide alternate importation routes.

A rise in homicides from 1999 through 2006, and continued incidence of other violent crimes have been attributed to the resurgence of violent gangs in major metropolitan areas, such as Chicago, Los Angeles, and New York, which average approximately 600 homicides per year. Within hours after celebrating the New Year, the city of Newark, NJ, experienced six homicides, all deemed gang-related.

Over the next five years, the Federal Bureau of Investigation must continue to focus the resources of Safe Streets Task Forces to combat those violent street gangs having major impact in our communities. This will necessitate use of RICO (Racketeering Influence and Criminal Organization Act).

New Poll: Reagan, FDR Lead Presidential Role Models for Obama

When American voters were asked which past President of the United States they believe Barack Obama should model his new presidency after, they did not pick Abraham Lincoln or John F. Kennedy, or even George Washington as their top choice. They picked Ronald Reagan, according to a poll conducted by Clarius Research Group

The nationwide survey conducted this past week showed that Reagan was the top choice among all voters with 26 percent, followed by Franklin D. Roosevelt with 18%, Kennedy with 17% and Lincoln with 13%.

"Reagan was the overwhelming favorite among Republican voters," said Dr. Ron Faucheux, President of Clarus. "He received 59 percent as the President GOP voters want Obama to emulate. Nobody else came close."

"Democrats scattered their choices more," Faucheux noted. "FDR was their top pick at 27 percent and was closely followed by Kennedy, with 26 percent. Lincoln, a Republican, ranked third among Democrats."

The following question was asked in the survey:

"If Barack Obama were to select one President from the past as a role model for his

presidency, which past President would you want him to use as an example:

George Washington, Thomas Jefferson, Andrew Jackson, Abraham Lincoln, Theodore

Roosevelt, Franklin Roosevelt, Harry Truman, Dwight Eisenhower, John Kennedy,

or Ronald Reagan?"

Other poll findings included:

-- Independents favored Reagan, followed by FDR, Lincoln and Kennedy.
-- Younger voters (under 30) selected JFK as their favorite. Reagan and
Lincoln followed.
-- Older voters (over 65) put Roosevelt first. Reagan was second.
-- White voters picked Reagan as their top choice with FDR in second
place.
-- African American voters favored Kennedy by a wide margin. Lincoln, the
Great Emancipator, came in second.
-- Home regions of past Presidents can still have political impact.
Reagan, from California, did the best in the West (30 percent) and the
worst in the Northeast (22 percent). FDR, a New Yorker, scored highest
in the Northeast (26 percent) and lowest in the Midwest (15 percent).
-- Reagan dominated small town and rural America, winning 31 percent.
Among urban voters, FDR led with 23 percent. Reagan was also favored
among suburbanites, capturing 28 percent.
-- Reagan won high-income voters (over $100,000 a year) with 33 percent
followed by FDR with 21 percent. JFK and Reagan, at 21 percent, tied
among voters with incomes under $50,000 a year.
-- Education was a factor in some cases. FDR received 14 percent among
voters without a college degree but 25 percent among those with
graduate degrees. Kennedy won 27 percent of voters with high school
educations and 14 percent among college graduates.

Presidents among the Founding Fathers -- George Washington and Thomas Jefferson -- received 4 and 3 percent, respectively. Cold War Presidents Harry Truman and Dwight Eisenhower also received 4 and 3 percent among all voters. Theodore Roosevelt, a progressive Republican, captured 4 percent; the Hero of the Battle of New Orleans, Democrat Andrew Jackson, received 1 percent.
